Family Visa After Divorce in the UAE: What Happens to the Ex-Wife's Visa, the Children's Visas, Custody, Timelines and Your Options in 2026

Your family visa after divorce does not end on the day of the divorce: the visa stays valid until the sponsor cancels it, and then a 59-day grace period starts. The ex-wife can apply for her own one-year residence within six months of the divorce, take a job or property visa, or move to a new husband. The children can stay with the same sponsor or move to the mother if she has custody and earns AED 4,000 (or AED 3,000 plus accommodation). This guide explains each route, the documents and the deadlines.

📌 THE SHORT ANSWER
After divorce, the sponsor cancels the ex-wife's visa — the children can stay where they are.
The ex-wife then has 59 days to get her own visa or leave. A divorced woman who was sponsored by her husband can get a 1-year residence without a sponsor if she applies within six months of the divorce. A mother with custody can sponsor the children with a salary of AED 4,000, or AED 3,000 plus accommodation. GDRFA or ICP decides each case.

⚖️ What happens to a family visa after divorce in the UAE?

A divorce in UAE courts is a court matter; a visa is an immigration matter. The two are linked, but the visa does not cancel itself. The residence stays valid until the sponsor cancels it — usually the husband — through GDRFA in Dubai or ICP in the other emirates. Each family member has a separate visa, so the ex-wife's visa and the children's visas can follow different routes.

👩 What happens to the ex-wife's visa after divorce?

In most cases the ex-husband cancels it. A dependent visa can only be cancelled by the sponsor; it costs AED 85 online or AED 189 at an Amer centre and takes about 48 hours. From the cancellation date, she has 59 days to change status or leave. See our visa cancellation guide and the grace period guide.

Visa options after divorce in the UAE: divorcee residence, own job or property visa or a new husband's visa for the ex-wife; children stay on the father's visa or move to the mother's; the sponsor cancels or transfers
Three visa routes after divorce: for the ex-wife, for the children and for the sponsor.

What are the ex-wife's options to stay in the UAE?

✓Own one-year residence for divorced women — see below.
✓Employment visa — a new employer sponsors her; the change of status is done inside the UAE during the grace period.
✓Property visa — any property in her name supports a 2-year property investor visa; AED 2,000,000 supports a 10-year Golden Visa.
✓Golden Visa on her own merit — see the Golden Visa page.
✓New husband's sponsorship — after a registered and attested new marriage.

🪪 Can a divorced woman get her own residence without a sponsor?

Yes. A foreign woman who was sponsored by her husband can get her own residence permit — without a sponsor — if she applies within six months of the divorce. ICP confirmed the conditions in September 2025:

✓She is inside the UAE.
✓Her husband was her sponsor at the time of the divorce.
✓She meets the financial solvency and suitable housing requirements.
iTo include her children, she must be their legal custodian and act as their sponsor.

The residence is issued for 1 year and can be renewed. Renewal for the children is referred to a competent committee, and custody disputes are decided by that committee. The fee is the amount shown in the GDRFA or ICP system when you apply.

When does the six-month window start?

From the date of the divorce. If her visa has already been cancelled, the 59-day grace period still applies — so apply early, before the grace period runs out, even if six months have not passed.

⚠️
Do not wait for the six months. The window is for applying; the grace period after a cancellation is 59 days. After that, overstay fines of AED 50 a day start.

👧 What happens to the children's visas after divorce?

Nothing, unless someone acts. The children's visas stay valid under the parent who sponsors them — usually the father. Cancelling the ex-wife's visa does not cancel the children's visas: each visa is separate.

1
Agree who will sponsor PREPARE
Father keeps the sponsorship, or the mother takes over. Custody decides in a dispute.
2
Collect the papers PREPARE
Divorce decree, custody order, consent letter — attested and translated into Arabic.
3
New sponsor applies APPLY
The mother applies for the children under her residence (new visa or transfer).
4
Old visas are cancelled IMMIGRATION
The old sponsor cancels; the new visas are issued without leaving the UAE.

Can the father keep sponsoring the children after divorce?

Yes. He can keep and renew the visas — sons up to 25, daughters while unmarried — with the same documents as any family visa renewal. In Dubai a tenancy contract is not required for children; in the other emirates it is.

Can the father cancel the children's visas without the mother?

The sponsor files the cancellation. But if custody is disputed, the court can order that the children stay in the UAE or that their passports are deposited. Get legal advice before any cancellation while a custody case is open.

👩‍👧 Can a mother sponsor her children after divorce?

Yes. A working mother with a valid UAE residence can sponsor her children. The salary rule is the same as for any sponsor: AED 4,000 a month, or AED 3,000 plus accommodation written in the MOHRE salary certificate.

Mother sponsoring children after divorce
RequirementWhat is checked
SalaryAED 4,000, or AED 3,000 + accommodation in the MOHRE salary certificate
CustodyCourt custody decision, or the divorce decree that names her as custodian
Father's consentNo-objection letter — often asked, especially when the father lives in the UAE
HousingDubai: no tenancy needed for children · other emirates: tenancy contract
CertificatesAttested birth certificates, attested divorce and custody papers, Arabic translation

What if the mother earns less than AED 4,000?

With AED 3,000 she qualifies only if accommodation is written in her MOHRE salary certificate. Otherwise the father can keep the sponsorship, or the one-year divorcee residence for mother and children can be considered by the committee. Our minimum salary guide has the details.

👨‍⚖️ How do custody and consent affect the children's visas?

Immigration follows the court. Under the federal personal status law in force since 15 April 2025, custody lasts until 18 for boys and girls, and from 15 a child can choose which parent to live with. Non-Muslim expatriates can fall under the civil personal status law, which starts from joint custody. A lawyer or the family court decides custody; the visa follows that decision.

Can I travel with my children after divorce?

Only with the other parent's consent or a court order. The 2025 law punishes travelling with a child without permission with a fine or imprisonment. If a travel ban is in place, the children cannot leave even with a valid visa.

⏱️ What is the timeline for visas after divorce?

Divorce and visa deadlines in the UAE: six months to apply for divorcee residence, a 59-day grace period after cancellation, AED 4,000 salary for a mother sponsoring children and an AED 50 daily fine after the grace period
Key deadlines after divorce: six months, 59 days, AED 4,000 salary and the AED 50 daily fine.
MomentWhat it means
Divorce dateThe six-month window for the divorcee residence starts
Cancellation of the ex-wife's visaAbout 48 hours to process; the 59-day grace period starts
Day 59Last day to change status or leave without a fine
From day 60Overstay fine of AED 50 a day; leaving also needs an exit pass of about AED 450
Children's visa expiryRenew under the father or transfer to the mother before it expires

What is the right order to do things?

1
Decide the new sponsor for each person and collect the documents first.
2
Apply for the new visa (divorcee residence, job, property or mother's sponsorship).
3
Cancel the old visa only when the new route is ready — or right away, but inside the 59 days.
4
Update the Emirates ID and health insurance under the new visa.

📂 Which documents are needed after a divorce?

1
Divorce decree — from a UAE court, or a foreign decree attested and translated.
2
Custody decision, if the mother sponsors the children.
3
No-objection letter from the father, where asked.
4
Attested birth certificates of the children and their passports.
5
Salary certificate, residence and Emirates ID of the new sponsor; tenancy contract outside Dubai.

Does a foreign divorce certificate need attestation?

Yes. A divorce decree or custody order from another country is attested in that country, by the UAE embassy there and by MOFA in the UAE, then translated into Arabic. See our MOFA attestation guide and legal translation.

🚫 What are the most common mistakes after a divorce?

✕Cancelling everyone at once. The children's visas do not need to be cancelled with the ex-wife's.
✕Waiting six months. After a cancellation, the 59-day grace period counts first.
✕Unattested custody papers. A foreign decree without MOFA attestation and Arabic translation stops the application.
✕Travelling with the children without consent. It can be a criminal offence and may trigger a travel ban.
✕Forgetting the Emirates ID and insurance. Both must follow the new visa.

❓ Frequently asked questions

1. What happens to my family visa after divorce in the UAE?

Nothing happens automatically on the divorce date. The ex-husband remains the sponsor until he cancels the visa. Once the ex-wife's visa is cancelled she has a 59-day grace period to get a new visa or leave. The children's visas can stay with the same sponsor or move to the other parent.

2. Can my ex-husband cancel my visa after divorce?

Yes. Only the sponsor can cancel a dependent visa, and after a divorce he usually does. The cancellation costs AED 85 online or AED 189 at an Amer centre and takes about 48 hours. After that you have 59 days.

3. Can a divorced woman stay in the UAE without a sponsor?

Yes. A woman who was sponsored by her husband can apply for her own residence within six months of the divorce, as long as she is in the UAE and meets the financial and housing conditions. It is issued for 1 year and can be renewed.

4. How long can I stay in the UAE after my visa is cancelled?

59 days from the cancellation date. After that the overstay fine is AED 50 a day.

5. What happens to the children's visas after divorce?

They stay valid under the parent who sponsors them, usually the father. At renewal he can renew them, or the sponsorship can move to the mother if she has custody and meets the salary rule.

6. Can a mother sponsor her children after divorce?

Yes. A working mother with a valid UAE residence can sponsor her children. She needs a salary of AED 4,000, or AED 3,000 plus accommodation, the custody document and, in many cases, the father's consent.

7. Do I need my ex-husband's consent to sponsor our children?

Usually a no-objection letter from the father, or a court custody decision, is asked for. If the court has given you custody, the decision is the key document. GDRFA or ICP decides each case.

8. What is the custody age in the UAE after the 2025 law?

Under the federal personal status law in force since 15 April 2025, custody runs until 18 for both boys and girls. From 15 a child can choose which parent to live with. Non-Muslim expatriates may fall under the civil personal status law, which starts from joint custody.

9. Can my ex-wife stay on my visa after divorce?

No, not for long. A divorced wife cannot remain your dependent. You cancel her visa and she moves to her own residence, an employment visa or another sponsor.

10. Do I have to cancel the children's visas if I cancel my ex-wife's visa?

No. Each dependent visa is separate. You can cancel the ex-wife's visa and keep the children on your sponsorship.

11. What documents does a divorced mother need to sponsor her children?

Her passport, residence and Emirates ID, a salary certificate, the children's passports and attested birth certificates, the attested divorce and custody documents with Arabic translation, a tenancy contract outside Dubai, and often the father's no-objection letter.

12. Does a foreign divorce certificate need attestation?

Yes. A divorce decree or custody order issued outside the UAE must be attested in the home country, by the UAE embassy there and by MOFA in the UAE, and translated into Arabic.

13. Can a divorced mother sponsor her children if she earns less than AED 4,000?

Only if she earns AED 3,000 and the accommodation is written in her MOHRE salary certificate. Otherwise the father keeps the sponsorship, or the divorcee residence route is used with the competent committee.

14. What if the ex-wife has no job after divorce?

She can apply for the one-year divorcee residence within six months of the divorce if she meets the financial and housing conditions, or find a job and take an employment visa during the 59-day grace period.

15. Can a divorced woman get a property visa?

Yes. A property in her name of any value can support a 2-year property investor visa, and AED 2 million can support a 10-year Golden Visa. She can then sponsor her children.

16. Can my ex-wife remarry and move to her new husband's sponsorship?

Yes. After the new marriage is registered and attested, the new husband can sponsor her if he meets the salary rule. Her children from the first marriage are a separate question and usually need custody papers.

17. Is there a fine if the ex-wife's visa is cancelled and she stays?

Not during the 59-day grace period. After it the fine is AED 50 a day until she changes status or leaves. Leaving with a fine also means an exit pass of about AED 450 at the airport.

18. Can I take my children out of the UAE after divorce?

Only with the other parent's consent or a court order. Under the 2025 personal status law, travelling with a child without permission can be punished with a fine or imprisonment.

19. What happens to a husband sponsored by his wife after divorce?

The same rules in reverse: the wife as sponsor cancels his visa, he has 59 days, and he needs his own employment, investor or property visa to stay.

20. Can FamilyVisa.ae move my children's visas to my sponsorship?

Yes. We check your salary, the custody documents and the consent letter, arrange attestation and translation, and apply for the new visas once the old ones are cancelled.
